By accessing or using InstaPosts ("the Service"), operated at instaposts.ai, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

InstaPosts is an AI-powered platform that enables users to generate carousel posts for social media using artificial intelligence. The Service includes template-driven generation, image editing, branding presets, and project management features.

3. Account Registration

To use the Service, you must:

• Create an account with a valid email address or sign in via Google
• Verify your email address (for email/password accounts)
• Be at least 13 years of age
• Provide accurate and complete information

You are responsible for maintaining the security of your account credentials and for all activities that occur under your account.

4. Subscription Plans and Billing

4.1 Free Tier

New users receive a limited number of free generation credits. Free credits do not roll over between billing periods.

4.2 Paid Plans

We offer Basic and Pro subscription plans with monthly and yearly billing options. Each plan includes a set number of generation credits per billing period. Subscription credits reset at the start of each billing period.

4.3 Add-on Credits

Additional generation credits can be purchased as one-time add-ons. Add-on credits carry over between billing periods and do not expire while your account is active.

4.4 Payment Processing

All payments are processed through Stripe. By subscribing, you agree to Stripe's terms of service. You may manage or cancel your subscription at any time through the Settings page.

4.5 Refund Policy

All purchases are final. We do not offer refunds for subscription fees, add-on credits, or any other charges. By completing a purchase, you acknowledge and agree to this no-refund policy.

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of any content you create using the Service, including generated carousel posts and uploaded images. You grant us a limited license to store and process your content solely to provide the Service.

5.2 AI-Generated Content

Carousel posts are generated using third-party AI models (Google Gemini, OpenAI). You are responsible for reviewing and ensuring that generated content is appropriate for your intended use. We do not guarantee the accuracy, originality, or suitability of AI-generated content.

5.3 Our Intellectual Property

The Service, including its design, templates, branding, and underlying technology, is owned by InstaPosts and protected by intellectual property laws. You may not copy, modify, or distribute the Service itself.

6. Acceptable Use

You agree not to use the Service to:

• Generate content that is illegal, harmful, threatening, or harassing
• Infringe on the intellectual property rights of others
• Distribute malware or engage in phishing
• Attempt to gain unauthorized access to the Service or its systems
• Use automated tools to scrape, crawl, or otherwise access the Service beyond normal usage
• Resell or redistribute the Service without authorization

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may perform maintenance, updates, or modifications that temporarily affect availability. We are not liable for any downtime or service interruptions.

8. Limitation of Liability

To the maximum extent permitted by law, InstaPosts shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Termination

We may suspend or terminate your account if you violate these Terms. You may close your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated terms on this page. Continued use of the Service after changes constitutes acceptance of the new terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
